articles 7 and 13
In accordance with
article 13 of Law n. 196/2003 “personal data protection code”, we inform you
that all personal data which you provide us, may be processed in compliance
with the regulation cited above and with the duties of confidentiality.
By processing of
personal data we mean the collection, recording, organization, retention, consultation,
elaboration, alteration, selection, extraction, combination, blocking, transmission,
dissemination, erasure and destruction of the data, or the combination of one
or more of these operations.
Providing us with
these data is optional
The data will be
processed using suitable means to guarantee security and confidentiality and
they may also be processed using automatic means which are able to store, manage
and transmit these data.
We inform you that
the aforesaid processing of your personal data will be handled directly by LPE
S.p.A.
We also inform
you that, with reference to the processing mentioned above, you are entitled
to exercise the rights set out in article 7 of Law n. 196/2003. This article
can be found attached and forms an integral part of this information sheet.
Pursuant to article
13, we ask you to note that the “eventual refusal to reply”, at the time the
information is collected, or the eventual refusal to have your data processed
could render it impossible for us to observe part of the legal and/or contractual
duties connected to your relationship with LPE S.p.A.
Purposes and conditions
of processing
Your personal data
have been acquired by us and will be processed by us:
- to fulfil legal and contractual obligations and for managerial, technical and statistical
operational requirements;
- manually
or by automatic means in such a way as to guarantee the security and confidentiality
of the data.
Providing information
and the consequence of refusal
Your providing
us with information is optional with the aim of collecting Curricula Vitae and
offering the opportunity to establish work relationships and/or collaboration.
Your refusal will
render it impossible to continue or to start acquiring your data and to their
insertion in our data banks.
Rights of the
party concerned
By contacting the
data controller or the data processor, the party concerned is entitled access
to his/her personal data in order to chock how these data are being used or,
to correct and update them within the limits set out in the law, or to request
their erasure or to object to their processing if the law is violated; the rights
of the party concerned are listed in article 7 of Law n. 196/2003 which you’ll
find attached and which forms an integral part of this information sheet.

Article 7
Right to access personal data and other rights
1. The party concerned
has the right to obtain confirmation as to whether personal data concerning
him/her exist, even if these data have not yet been recorded, and the communication
of the same in an intelligible form.
2. The party concerned has the right to be informed of:
a) the source of the personal data;
b) the purposes for and means by which the data are being processed;
c) the logic involved where the data are processed by automatic means;
d) the identity of the data controller, the data processors and the representative
appointed in compliance with article 5 paragraph 2 of Law n. 196/2003;
e) the recipients or classes of recipients to whom the personal data may be disclosed
or who may become acquainted with said data in their capacity as representative
appointed within the State territory.
3. The party concerned has the right to obtain:
a) the
updating, rectification of the data, or their integration if the party concerned
has a legitimate interest in it;
b) the
erasure, transformation to anonymous data or the blocking of data handled in
violation of the law including data whose storage is not necessary for the purposes
for which they have been collected and processed;
c) The
certification that the operations as per letter a) and b) above have been notified
to the third parties to whom the data have been transmitted or disseminated,
unless this proves impossible or involves a clearly disproportionate effort
compared with the right that is to be protected.
4. The party concerned has the right to object, completely or in part:
a) on
legitimate grounds, to the processing of personal data concerning him/her even
when related to the purposes for which they were collected;
b) the
processing of personal data relating to him/her for the purpose of sending advertising
or marketing material, or for direct marketing, market research or business
communications.
